General Terms & Conditions
1. Booking, Confirmation and Payment
(a) In order to secure a booking you should send us a deposit of 30% of the program price or, in the case of bookings made
within 20 days of departure, 60% of the program price.
(b) We will then send you a written confirmation of the booking so as
to establish a binding contract between us, which will be governed by
the laws of Brazil and subject to the exclusive jurisdiction of the
competent courts in Brazil. In order to participate in the program, the
contract must be signed and submitted to us on your arrival in Brazil.
(c) The second payment of 30% of the program must be paid not
later than 20 days prior to departure and if not received on time we
reserve the right to treat the booking as cancelled by you and to levy
cancellation charges as set out below. Guests with outstanding payments
will not be permitted to participate in the program.
(d) The balance of the program must be paid not later than on the day
of arrival. Guests with outstanding payments will not be permitted to
participate in the program.
(e) Funds are non-refundable in the event of early departure.
2. Alterations by you:
If, after we have confirmed a booking, you request a change in the
dates or content of your itinerary we will do our best to meet your
revised requirements and reserve the right to charge an alteration fee
of U$150, but any such requests received within 20 days before
departure may be treated as a cancellation and re-booking and thus
subject to cancellation charges.
3. Cancellation by you
(a) Cancellations by you must be in writing to us and will be effective
only upon receipt by us by registered mail. Cancellations notified by
fax will be only valid if signed by the signatory to the booking form
and only provided that we later receives a written confirmation of the
cancellation within twenty (15) days prior to the date of departure.
Once the above mentioned term has expired without us receiving the
written confirmation, the notification by fax will be invalidated and
cancellation charges stated below will apply.
(b) Depending on when notification of cancellation is received so cancellation charges will apply as follows:
Days prior to departure
Percentage of Program Price
35 or more days : U$ 120 processing fee
Between 25-34 days : 30% of the price
Between 16-24 days : 50% of the price
Less than 15 days : 100% of the price
c) We cannot give any allowance or refund for meals, accommodation,
transport etc, not taken when these are included in the program price
nor once the program has started can we give any refunds for canceling
part of the program.
(d) If your reason for canceling is because of events beyond your
control (e.g. illness declared by a doctor, death of a close relative,
etc.), you may transfer your booking to another party, provided that
you give us reasonable notice to make such arrangements and that the
transferee pays any outstanding payment under the contract. Until this
occurs, you will be obliged and liable under the terms of the contract.
4. Alterations and cancellation by Us.
Once your booking has been confirmed we will make every effort to
provide you with the booked program arrangements but reserve the right
to alter or cancel the whole or part of the program if we cannot avoid
doing so. Reasons for doing so would include, but are not limited to,
extreme adverse local weather conditions, natural disasters, civil
strikes or war, terrorist activity, fire, drought conditions and
similar, insufficient number of guests and/or any circumstance or
situation of that kind.
If any such alterations are significant, then you will have the
right to cancel the program. Depending on when the alteration occurs,
so refunds will apply as follows:
Before arrival and during the first complete day of scheduled activities: 100% of the monies paid
After two complete days of scheduled activities: 85% of the monies paid
After three complete days of scheduled activities: 70% of the monies paid
After four complete days of scheduled activities: 50% of the monies paid
After five complete days of scheduled activities: 25% of the monies paid
After six complete days of scheduled activities: no refunds will be returned.
In all events we will do our best to provide you with comparable
alternative arrangements which may involve a different price and
different activities. If they are not acceptable to you, then, if
appropriate, we will pay you a compensation up to a maximum of 2% of
the program price.
5. Prices and increases.
(a) Unless otherwise agreed, the program price does not include the
cost of flights, airport taxes, land or air charters, transportation of
any kind, accommodation, boating, diving and entertaining activities of
any kind, except for the following included in the program price:
(i) Scheduled transportation
from Rio International Airport to boutique guesthouse (round trip).
(ii) Double occupancy
accommodation and all meals from Sunday morning through Sunday
afternoon.
(iii) Activities specifically included in the program schedule.
(b) Not included in the program price is travel insurance, excess
baggage charges, tipping for services, drinks in restaurants and during
outdoors activities, meals not included in the program, and items of a
personal nature.
(c) The program price is based on costs known at the date of
booking and on relevant rates as at that date and is subject to
variation only to reflect subsequent increases in transportation costs
(including fuel and air fares), dues, taxes (including VAT) and fees
chargeable for services or adverse exchange rate variations. Even so we
will absorb any such price increases up to an equivalent of 2% of the
program price but if the necessary price increases exceed that level
then we will notify you accordingly and reserve the right to charge you
that extra amount up to a maximum of 10% at which level you will have
the right to cancel the program within 14 days of such notification
with full refund of all monies paid or we will have the right to charge
you such excess over 10% of the program price. Notwithstanding the
provisions of this clause the program price will not be increased
within eight weeks of departure
6. Our responsibilities
(a) Our statutory liability is subject to brazilian applicable law. We
are not responsible where failure to perform the contract or its
improper performance is due or attributable to our fault or that of
anyone supplying services to us, to your fault, unforeseeable or
unavoidable failures attributable to unconnected third parties, Force
Majeure or events which neither we nor our suppliers could, even with
all due care, foresee.
(b) Please note that we cannot accept any responsibility for weather
conditions or the presence or absence of particular wildlife from your
program. In particular, severe drought conditions can lead to local
authorities imposing restrictions on use of water and electricity.
Every effort will be made to ensure that you are not subject to
inconvenience due to any of the above, but no responsibility can be
accepted if this does occur.
(c) If you are unhappy with any part of the program, you must address
your complaint at the earliest opportunity to us. If the problem is not
resolved by the end of your program, then you must supply us with full
written details within 30 days thereof. Failure by you to complain at
such earliest opportunities may prejudice your legal rights.
(d) We are not responsible for any loss, death or injury that is
attributable to your acts or omissions, or the acts or omissions of
third parties not involved in providing the services which make up your
program with us. Nor are we liable for unusual or unforeseen
circumstances whose consequences could not have been avoided by
exercising all due care. You are responsible for the conduct of any
children traveling with you and for their compliance with the condition
set out in section 7 of these conditions, and in particular those in
section 7(b).
7. Your Responsibilities
(a) It is your responsibility that passports (with at least 6 months
validity beyond the date of your return), visas, travel insurance, and
other necessary travel documents are in order and we reserve the right
to charge you any costs incurred by us due to your failure in any of
these respects. It is also your responsibility to check in for your
flights by the correct time and to be in the right place at the right
time for ground travel arrangements. We do not accept liabilities if
you fail to do so and no credits or refunds will be given for lost or
mislaid air tickets or other travel documents.
(b) It is a condition of your contract with us that you act with
reasonable prudence and circumspection whilst on program and that you
comply with all health and safety requirements of guides, trails etc.
(c) As between you and suppliers of accommodation, transport and
other services which form part of the program, their conditions of
business will apply.
8. Insurance
It is your obligation and a binding condition of your contract
with us that you take out personal medical insurance covering the
following items and amounts of coverage:
· Medical assistance must include Doctor’s
consultations, medical attention from specialists, supplementary
medical examinations, physical recovery therapy, hospitalization,
surgery, intensive care and coronary unit (overall maximum limit should
be at least US$ 100,000 for accidents and US$ 15,000 for illness).
· Medicines (ambulatory up to a minimum of US$ 2,000 and in case of hospitalization up to US$ 4,000).
· Emergency Odontology up to a minimum of US$ 150 per tooth.
· Urgent medical transfers (either by land, air or water) in case of emergency.
· Medical repatriations.
· Reimbursement of medical expenses incurred in case of impossibility of contacting the medical insurance company.
MAKE SURE THAT ALL SERVICES INCLUDED IN THE PERSONAL MEDICAL
INSURANCE ARE RENDERED IN THE AREA OF RIO DE JANEIRO, STATE OF RIO DE
JANEIRO, BRAZIL, AND THAT THE POLICY COVERS (WITHOUT ANY RESTRICTIONS
AND/OR EXCEPTIONS) SPORTS AND OUTDOORS ACTIVITIES.
A copy of the medical insurance documentation involving items and
amounts covered, validity, terms and extents of the coverage, etc.,
must be faxed to us within 10 days before departure. Guests with no
medical insurance will not be permitted to participate in the program,
being such circumstance taken as a cancellation by You, in which case
Sections 3 (b) and 3 (d) will apply.
It is advisable that the insurance policy also covers:
· Lost baggage.
· Reimbursement of expenses due to delayed or cancelled flight.
· Hotel expenses due to convalescence.
· Legal assistance.
